Article 1 – Purpose
These conditions govern sales by La Ressourcière whose head office is located at 32 impasse des Tulipes - 83210 LA FARLEDE, in France, registered in the business directory under the number: 529 656 712. The site www.la-ressourciere.com is the property of La Ressourcière in its entirety.
Article 2 – Acceptance of the general conditions of sale
The customer acknowledges having read, at the time of placin
g the order, the special conditions of sale and declares to accept them in their entirety. These general conditions of sale govern the contractual relations between La Ressourcière and its client. These general conditions of sale take precedence over any other conditions appearing in any other document. The resourcière is free to modify these General Terms and Conditions at any time. In the event of modification, the General Terms and Conditions which are applicable to the order are those which were online and which the customer accepted on the day the order was transmitted.
Article 3 – Product
The products sold on the La ressourcière site are renovated and redesigned furniture, second-hand objects. The product catalog is constantly evolving. Each product is accompanied by the most exhaustive description possible. The furniture and objects offered are old. They bear the trace of their history (marks, chips, scratches, etc.). Despite careful work, these "marks" are an integral part of the product. Being old, they no longer correspond to current safety standards in force in France and abroad. It is therefore up to the customer to ensure their proper use. The photographs, the exclusive property of La ressourcière, are as faithful as possible but cannot ensure perfect accuracy with the product presented, particularly with regard to colors and materials. They are displayed for illustrative purposes and have no contractual value.
Article 4 – Price
The prices of our products are indicated in euros, all taxes included, unless otherwise indicated and excluding shipping costs. These fees vary depending on the weight and volume of the products. For furniture, they will be indicated to the buyer when contacting La Ressourcière to find out the terms of payment and delivery. For tableware and decorative items, these costs will appear at the time of ordering.
For an order to a country other than mainland France, as importer of the product(s) concerned, the customer may be subject to customs duties or other local import taxes. It is important that he obtains information beforehand from the local authorities in his country. These rights and amounts do not concern La resourcière. They will be the responsibility of the customer and are their entire responsibility (declarations, payments to the competent authorities and organizations in the country).
All orders regardless of their origin are payable in euros.
La resourcière reserves the right to modify its prices at any time. The product will be invoiced on the basis of the price mentioned on the site at the time of validation of the reservation.
The products remain the property of La resourcière until full payment of the price.
NOTE: upon taking physical possession of the ordered products, the risk of loss or damage of any kind to the products is transferred to the customer.
Article 5 – Order conditions
All orders/reservations go through the website “www.la-ressourciere.com”. Confirmation of the order entails full and complete acceptance of these general conditions of sale, without exception or reservation and the renunciation of taking advantage of its own conditions of purchase or any other conditions whatsoever. All data transmitted and the recorded confirmation constitute proof of the nature of the content and date of the transaction, signature and acceptance of the operations carried out. The resourcer will only be committed to executing the order after acceptance of the customer's order, confirmed by an email sent to the address that the customer has communicated and receipt of payment prior to delivery. La resourcière reserves the right to cancel any order from a customer when a dispute relating to the payment of a previous order exists. In the event of an error in the wording of the delivery details, La resourcière cannot be held responsible for the impossibility of delivering the order.
Article 6 – Payment terms
Furniture :
The customer can pay by bank transfer (communication of the IBAN of La Ressourcière). Payment is based on the price of the furniture and transport. The order validated by the customer will only be considered effective when Ressourcière has received payment. Otherwise, the order will be automatically canceled and the customer will be notified by email. The resourcer will issue an invoice which will be attached to the package including the order in the event that the billing address is identical to the delivery address. If this differs, the invoice will be sent by email separately.
Tableware/decoration:
The customer can pay for their order directly by credit card on the site. Payment is based on the price of the basket and transport. The order validated by the customer will only be considered effective when Ressourcière has received payment. Otherwise, the order will be automatically canceled and the customer will be notified by email.
Article 7 – Packaging
The packaging of La Ressourcière products is, for the most part, cardboard or other means of recovery protection. They can therefore mention various logos and graphics. The main idea of the La ressourcière concept being “everything is a resource”, these boxes also have a second life.
Article 8 – Delivery terms
FURNITURE :
3 possibilities to recover your furniture:
Hand delivery:
The customer can collect their order from the La Ressourcière headquarters. To do this, once payment has been made, it will mention “collection on site” in the comment on the contact page. The resource manager will contact the customer by email and will then make an appointment for collection.
Free delivery by me within a 30 km radius around La Farlède.
Delivery by COCOLIS carrier or a pre-defined carrier:
Transport costs are the responsibility of the customer.
The order processing time is 3 to 5 days after receipt of payment on La ressourcière's account. The furniture is sent by COCOLIS carrier or a pre-defined carrier. The delivery time may vary depending on the destination and the volume of the furniture and the carrier's deadlines. The resourcière reserves the right to cancel an order when it cannot be delivered by (unavailability of the customer at the delivery address after making several appointments by the carrier).
Delivery is made at the foot of the building and the carrier cannot take back the delivered product. The customer is required to check, in the presence of the carrier, the condition of the packaging and its contents.
Possible delivery delays do not give the right to claim damages. Upon receipt of the furniture, it is the customer's responsibility to check the package. In the event of an anomaly (pierced, opened or damaged package), the customer may refuse the package. La resourcière cannot be held responsible.
The customer can, if he wishes, organize delivery himself by the carrier of his choice. The resourcière declines all responsibility in the event of damage caused to the goods during transport.
Delivery of other products:
Other products will be shipped by Mondial Relay. The buyer must mention the precise address of the relay point from which he will collect his package in the delivery address.
Article 9 – Liability
The products offered by La ressourcière comply with current French legislation. The responsibility of the company La resourcière cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is up to the customer to check with the local authorities in their country about the possibilities of importing or using the products ordered on this site. La resourcière cannot be held responsible for damage resulting from improper use of the purchased product. La ressourcière cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses. The responsibility of the resourcer will, in any case, be limited to the amount of the order and cannot be called into question for any error or omission which has remained despite the precautions taken in the presentation of the products offered on the site
Article 10 – Disputes
Good faith complaints or disputes are always received with kindness.
In the event of a dispute, the customer may send his or her complaints in writing to La Ressourcière in order to obtain an amicable solution.
Article 11 – Personal data collected on the site
The resource manager collects the customer's nominative information and personal data. They are necessary for the management of the customer's order.
They may also be transmitted to companies which manage order processing, payment and delivery. They are not communicated to canvassing, prospecting or advertising companies.
This data is kept in compliance with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and personal data.
Article 12 – Intellectual property
All elements of the site www.la-ressourciere.com are and remain the intellectual and exclusive property of the company. It is prohibited to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site.
